Terms & Conditions

1. General

These Terms & Conditions apply to all services provided by Brothers Home Service Ltd (“we”, “our”, “us”). By accepting a quote or engaging our services, you (“the customer”) agree to these terms.

2. Quotes & Acceptance

  • All quotes are valid for 30 days unless stated otherwise.
  • Acceptance of a quote (written, verbal, or deposit payment) forms a binding agreement.
  • Any changes to the scope of work may result in additional charges.

3. Scope of Work

  • Work will be carried out as outlined in the accepted quote.
  • Any additional work requested outside the agreed scope will be quoted separately or charged as a variation.
  • We reserve the right to decline work that is unsafe or outside our expertise.

4. Pricing & Payment

  • Prices are in NZD and may include GST unless stated otherwise.
  • A deposit may be required before work begins.
  • Full payment is due upon completion unless otherwise agreed.
  • Late payments may incur additional fees or interest.
     

5. Ownership of Goods (Retention of Title)


All goods and materials supplied by Brothers Home Service Ltd remain our property until full payment has been received.

Until payment is made in full:

  • The customer holds the goods as bailee for us.
  • We reserve the right to enter the property (at reasonable times and with notice where practicable) to recover unpaid goods.
  • The customer must not sell, dispose of, or alter the goods in a way that affects our ownership.

Risk in the goods passes to the customer upon delivery or installation.

6. Variations & Additional Costs

  • Any changes requested after work has commenced may result in additional costs.
  • Unforeseen issues (e.g., structural problems, hidden damage) may require extra work and charges.
  • We will communicate and seek approval before proceeding where possible.
     

    7. Materials & Supply

  • We may supply materials or install materials provided by the customer.
  • We are not responsible for defects in customer-supplied materials.
  • Additional costs may apply if supplied materials are unsuitable or cause delays.
     

    8. Installation & Workmanship

  • We aim to deliver high-quality workmanship in all services.
  • Minor variations in finish may occur due to material characteristics.
  • The customer must ensure the site is accessible and ready for installation.
     

    9. Access & Site Conditions

  • The customer must provide safe and reasonable access to the worksite.
  • Delays caused by restricted access or unsafe conditions may incur additional charges.
  • We are not responsible for delays outside our control.
     

    10. Cancellations & Rescheduling

  • Cancellations must be made with reasonable notice.
  • Deposits may be non-refundable if materials have been ordered or work scheduled.
  • We reserve the right to reschedule due to weather, supply issues, or unforeseen circumstances.
     

    11. Liability

  • We take care to avoid damage; however, we are not liable for:
    • Pre-existing damage
    • Hidden structural issues
    • Normal wear and tear
  • Our liability is limited to the value of the services provided.
     

    12. Warranty

  • We provide a workmanship warranty of 10 years from completion.
  • This does not cover:
    • Misuse or damage after installation
    • Normal wear and tear
    • Issues caused by third parties or customer-supplied materials

13. Cleaning & Completion

  • We will leave the work area in a reasonable condition upon completion.
  • Final cleaning beyond standard worksite tidy-up is not included unless specified.
     

14. Dispute Resolution


If any dispute arises in connection with our services:

  • Both parties agree to first attempt to resolve the matter through good faith negotiation.
  • If the dispute cannot be resolved, it may be referred to mediation before any legal action is taken.
  • If mediation is unsuccessful, the dispute may be resolved through the Disputes Tribunal or courts of New Zealand, as appropriate.

Each party will bear their own costs unless otherwise determined by the relevant authority.

15. Health & Safety

  • We comply with New Zealand health and safety regulations.
  • Customers must ensure a safe working environment, including keeping children and pets away from work areas.

 

16. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control, including weather, supplier delays, or unforeseen circumstances.

17. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.
